Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the Be Better Bit-By-Bit (B^5) mobile application, website, products, and services (“Service”), operated by Mango Innovations (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these terms, you are not authorized to use the Service.
Eligibility
You must be at least 18 years old to use our Service, or if you are under the age of 18, you must have your parent or legal guardian’s permission. By agreeing to these Terms, you represent and warrant to us that you meet these eligibility requirements.
Account Registration and Security
You may be required to register for an account to access certain features of the Service. You agree to (a) provide accurate, truthful, current, and complete information; (b) maintain and promptly update your account information; (c) maintain the security of your password; (d) accept all risks of unauthorized access to your account; and (e) immediately notify us if you discover or otherwise suspect any security breaches related to the Service.
Content and User Contributions
The Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post, or display on or through the Service, and you are responsible for protecting those rights.
Prohibited Conduct
You agree not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the Service in any medium; (b) using any automated system, including “robots,” “spiders,” “offline readers,” etc., to access the Service; (c) transmitting spam, chain letters, or other unsolicited email; (d) attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service; (e) taking any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure; (f) uploading invalid data, viruses, worms, or other software agents through the Service; (g) collecting or harvesting any personally identifiable information, including account names, from the Service; (h) using the Service for any commercial solicitation purposes; (i) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding, or attempting to hide your identity; (j) interfering with the proper working of the Service; (k) accessing any content on the Service through any technology or means other than those provided or authorized by the Service; or (l) bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.
Intellectual Property Rights
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Mango Innovations and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Mango Innovations.
Changes to the Service
We reserve the right to withdraw or amend our Service and any service or material we provide via the Service at our sole discretion and without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, a breach of the Terms.
Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. Mango Innovations and its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components, or d) the results of using the Service will meet your requirements.
Limitation of Liability
In no event shall Mango Innovations, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
